The Labour Court disallowed a union appeal over a Gresham Hotel painter’s pay, in a decision dated 2 May 2002. It found no evidence that his pay was formally linked to the Construction Industry Registered Employment Agreement rate and agreed with the Rights Commissioner’s recommendation. The union said the weekly difference between the worker’s pay and the industry rate was €114. The hotel disputed that a link existed and said his pay included a 2.5% service charge.
