The Labour Court upheld a Rights Commissioner’s £12,000 recommendation for a worker’s lost earnings after an appeal by the East Coast Area Health Board. The decision was signed on 29 April 2002. The worker, represented by the Services Industrial Professional Technical Union, had worked at James Connolly Memorial Hospital and later became Waste Management Adviser. The union argued that his shift premium should have been consolidated into basic pay and that he should have received credit for time spent on secondment when permanently appointed to the role. The Board argued that he had received his pay and allowances and that his starting salary followed promotion rules. The Court found no sufficient basis to interfere with the recommendation, which it said should be treated as full and final settlement of all outstanding issues affecting the claimant.
