In 2001, the Labour Court upheld Peter Mannion’s appeal over his alleged unfair dismissal and awarded him £250 in compensation. The Court found the procedures surrounding his dismissal were unfair. Its decision was dated 12 February 2001 and rejected the Rights Commissioner’s recommendation that Mr Mannion accept he had no dispute with Moylough Concrete Products Ltd.
Mannion said he wrote twice seeking clarification of his position but the company did not reply, and that it delayed issuing his P45 until April 2000. The company denied dismissing him and said he had been warned about absenteeism. It said he missed 35½ of 82 working days. The Court noted his absences, but found that the company ignored his letters and did not tell him it was dismissing him until April.
