The Labour Court upheld Garrett Engine Boosting Systems’ appeal, leaving a worker’s one-day suspension and final written warning in place. The decision was signed on 19 October 2001. The discipline followed allegations of bullying and harassment of canteen staff. The company said it had investigated the allegations and considered the action appropriate; the Technical, Engineering and Electrical Union argued that the company acted without consultation and had not given it substantial evidence against the worker. The Court said there was a serious problem of harassment and abusive behaviour within the company. It called for fair grievance, disciplinary, complaints and investigation procedures.
