The Labour Court upheld the Services Industrial Professional Technical Union's appeal and recommended that Southern Health Board accommodate a worker for a lateral transfer. The decision was dated 25 May 2001. The Court found that the worker's name had been overlooked when a 1999 agreement on lateral transfers was finalised. It said he would have been on the list for a transfer had his case been discussed.
