Appeal against 60-home development in Tipperary fails as planning is granted

An Coimisiún Pleanála has granted planning permission for a 60-home development in north Tipperary after an appeal was lodged against the project.
Tipperary County Council granted permission to O'Ceallaigh Westfield Ltd for the 60 home development on the Brittas Road, which would see five four-bedroom, 27 three-bedroom, and 12 two-bedroom houses built.
They also sought permission for the construction of two duplex blocks, each with eight duplex units – four one-bedrooms and four two-bedrooms.
Alongside the housing, the plans also include a creche with space for 47 children.
Dermot Ryan appealed the granting of permission to the planning appeals board on behalf of the Marlstone Manor Residents Association.
In a letter to An Coimisiún Pleanála (ACP), Mr Ryan said that the development would raise concerns about traffic flow on the Brittas Road.
"We feel that the proposed sightlines, which appear to have been assessed in accordance with DMURS (the Design Manual for Urban Roads and Streets) standards are not necessarily the correct application for this particular site,” the appeal letter said.
The proposed entrance to the estate is on the N62 road, which links Thurles and Templemore, is “a particularly busy corridor with agricultural, heavy goods and significant levels of commuter traffic,” the appeal added.
Despite these concerns, An Coimisiún Pleanála granted planning permission for the development.
An ACP inspector said that the proposed development “will not negatively impact on the amenities of properties or the surrounding area.”
The development would also “provide safe vehicular access with sufficient sightlines and will not give rise to undue impact to the capacity of the adjacent junctions, and will not give rise to a risk to public health,” the inspector said.
"The proposed development would provide satisfactory levels of residential amenity and will integrate appropriately within the established character of the area,” the An Coimisiún Pleanála inspector added.
ACP attached 20 conditions to the permission, including that the development must be built in three phases.
The first phase of the development will include 21 homes, the second will deliver 23 houses and 16 duplex units, while the creche will be constructed in the final development phase.
The inspector also stipulated that any area set aside for public amenity space can only be used for this, and that all cables associated with the development are hidden underground.
