Younis Sarwari’s racial discrimination claim rejected by WRC

By Donal Gilhooly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Younis Sarwari’s racial discrimination complaint against Garryowen Mall’s operators was declared not well founded by the Workplace Relations Commission, in a decision reported on 21 April 2023.

The complaint concerned an alleged racial remark by the shopping centre’s general manager during an interaction on 26 February 2021. The manager said he had only asked Sarwari to take his hands out of his pockets.

Adjudicating officer Ewa Sobanska found Sarwari’s evidence unreliable and unpersuasive, and said the manager’s account was more compelling, cogent and consistent. The Commission found that direct discrimination had not been established.

The report said an employer-appointed barrister had found that nothing untoward occurred, with that finding later upheld on appeal.
