The Workplace Relations Commission rejected Seamus Behan’s unfair dismissal claim against Liberties Recycling Development and Training CLG. Adjudicator Eileen Campbell found his conduct during a December 2023 altercation to be aggressive, uncontrolled and unacceptable, and said there were substantial grounds for his dismissal.
Behan, a van driver with 12 years’ service, was dismissed in February 2024 after an incident with a colleague. The company said its finding of gross misconduct followed a fair investigation; Behan disputed the account and said CCTV would support his version, while the company said the footage had been taped over during the Christmas break.
