The Workplace Relations Commission rejected Maebh Keary di Lucia’s employment rights complaints against RTÉ, finding she had not established in evidence that she was an employee during the period at issue. Adjudicator Christina Ryan said that although Keary di Lucia submitted about 4,400 pages of documents, they had not been opened, explained or verified in her oral evidence, so she could not attach evidential weight to them.

Keary di Lucia had claimed she was misclassified as a contractor between 2004 and 2011, leaving her short of about €360,000 in entitlements and earnings. She pointed to determinations by the Department of Social Protection, the Social Welfare Appeals Office and the Revenue Commissioners that she had been an employee before receiving a contract of employment in 2011, despite being paid by invoice.

At the hearing in 2025, broadcaster Colm Ó Mongáin testified that he overheard a manager tell a senior video editor to use her only as a last resort for shifts after she sought improved working conditions.
