WRC rejects Joseph Kelly’s pay and holiday claims against RTÉ on time-limit grounds

The Workplace Relations Commission ruled it had no jurisdiction to hear Joseph Kelly’s complaints seeking retrospective pay and holiday entitlements from RTÉ, because they were filed outside the statutory timeframe.
Kelly said RTÉ required him to register as a contractor with Revenue when he began working for the broadcaster in September 2012, and that he lost employee entitlements during more than six years in that status. RTÉ disputed that he was owed unpaid leave or public holiday entitlements. The claims were lodged in October 2024.
Adjudicator John Harraghy said he could consider only complaints filed within the time limits set by law and was not empowered to extend those limits. He therefore declined jurisdiction over Kelly’s complaints; the ruling did not determine whether the disputed entitlements were owed.
