The Workplace Relations Commission rejected Ger Malone’s claim that SIPTU penalised her for making protected disclosures. Adjudication officer Marie Flynn accepted five of the 17 disclosures Malone identified, but found she had not established penalisation in any of the 29 alleged acts; several complaints were also excluded as time-barred.
Flynn said the first 19 allegations of penalisation were outside the inquiry because no extension of time was granted. She assessed the remaining 11 individually and found none amounted to penalisation under the Act. The decision was made under the law in force when Malone lodged her claim in November 2022.
