The Workplace Relations Commission ruled that Avoca Handweavers unfairly dismissed head chef Giorgio Romano in August 2024 and ordered the company to pay him €40,000 compensation. The decision followed his dismissal over inaccurate chilling records for two batches of food.
Adjudication officer Dónal Moore said dismissal was harsh and a less onerous sanction should have been applied. He found that CCTV had been used for a purpose for which it was not intended, the company had done little to verify Mr Romano’s explanation that he was overwhelmed and needed further training, and the evidence showed new kettle processes needed adjustment. He also said Mr Romano was not blameless because he had not reported his error.
The WRC ruled out reinstatement or re-engagement, and said the €40,000 award reflected Mr Romano’s significant responsibility for his dismissal.
