WRC finds hotel operator reasonably dismissed night manager but awards him €3,000 over missed appeal

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Workplace Relations Commission awarded Omar Mohammed Osman €3,000 for unfair dismissal after Cantarini Limited failed to respond to his email seeking to appeal his dismissal from his night manager role at Dublin’s City Quay aparthotel. The WRC found the company had acted reasonably in dismissing him, but that its failure to handle the appeal was a procedural flaw.

The disciplinary decision followed findings that Osman had bullied and harassed a colleague in relation to sexual orientation and race. Osman denied all the allegations made against him by the colleague, identified as Mr D.

Adjudicator Catherine Byrne rejected Osman’s claims that the disciplinary action was retaliation for workplace grievances, concluding he had played a part in the staff conflict and raised his grievances to distract from the colleague’s complaint. The WRC also rejected his claims under the Protected Disclosures Act and the Safety, Health and Welfare at Work Act.
