WRC awards Nancy Doherty €20,300 over disability discrimination and missing contract

The Workplace Relations Commission found that Figary Water Sports Development Company Ltd discriminated against Nancy Doherty on grounds of disability by removing her remaining working days in December 2023. It awarded her €20,000 compensation for discrimination and a further €300 for the company’s failure to provide written employment terms, a total of €20,300.
The WRC accepted that Ms B carried out work and was paid, making her a valid comparator, and found that the company did not rebut the resulting case of discrimination. It also noted that the company took no steps to clarify or reverse the instruction that Ms Doherty should not attend work. The adjudicator said the finding related to the December removal of her hours; the earlier reduction was accepted at the time.
An account of the decision says the level of compensation was reduced to reflect payments the company continued to make to Ms Doherty for a period after her employment ended.
