Worker loses Payment of Wages claim against transport company

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

An anonymised worker’s Payment of Wages claim against a transport company failed at the Workplace Relations Commission, in a decision dated 20 June 2022. The complaint concerned wages during a medical review after colleagues alleged that the worker had fallen asleep while driving a coach. He denied that this had happened.

Adjudication Officer Caroline Browne found the worker had not made himself available for agreed alternative duties while awaiting the assessment. She concluded that outstanding payments had been made in full.

The decision records that the worker had worked for the company for more than five years and sought €4,825 in lost wages. The claim was brought under the Payment of Wages Act 1991.
