A woman was ordered to pay her former husband €1.6 million as part of a High Court divorce settlement. The proceedings were reported on 2 November 2022.

Mr Justice John Jordan granted the couple a divorce. He ruled that the woman should retain the family home, buy out her former husband’s share for €900,000 and continue to pay the mortgage.

The judge also ordered a pension adjustment giving the man 29.4 per cent of her pension funds, or €470,000. He directed her to pay a further lump sum of €280,000 before the end of January 2024.

The court made an order for joint custody with a shared parenting regime for the couple’s two children. The judge expressed the view that both sides should pay their own legal costs.

The judge rejected the woman’s allegations that her former husband had assaulted, abused and threatened her, finding that they had not been made out. He said the man had accepted losing his temper on occasions and had let himself down when that happened, but the judge was satisfied he was not violent.

The judge said there was no independent evidence supporting the woman’s allegations and that her evidence was not persuasive. The court was not prepared to make orders that would trigger a sanction under section 20(2) of the 1995 Family Law Act.
