A woman lost her High Court application for further investigation of her estranged husband’s financial affairs by the Official Assignee, Chris Lehane, over claims that he may have hidden assets. The proceedings were reported on 19 February 2018.
The husband opposed the application and denied that he had hidden or failed to disclose assets to the Official Assignee. Ms Justice Caroline Costello said the Official Assignee had made no complaint about his cooperation and was satisfied that no further investigation was required into the vast majority of the matters raised.
The judge dismissed the application and allowed the man to exit bankruptcy. She said an investigation into two discrete matters in his statement of affairs was continuing, and the Official Assignee had said it could continue without an order preventing his discharge.
