Mr Justice Mark Sanfey granted a woman permission, on an ex parte basis, to have her case against a solicitor’s firm listed later in July. The proceedings were reported on 12 July 2024. The application had been due to come before the courts in October.
The woman claims the firm is withholding deeds she needs to sell her family home, estimated to be worth €1.5 million. She must sell it to comply with orders made in her divorce proceedings. She also wants to avoid further dealings with her former husband when he is released from prison.
The High Court heard that he was serving a prison sentence for violent acts against her, including assaulting and threatening to kill her, and was due to be released the following year.
Her case seeks an order requiring the firm to provide the original title deeds and a file arising from a retainer. The firm claimed in a recent email that it was owed €10,000 for a property sale that did not proceed; she denies owing it money. The woman was represented by Gabriel Gavigan SC and David Geoghegan BL.
