A Wicklow man who pleaded guilty to assault has said that he believed he needed to use force.

Ronan Maguire (39), of Schooner House, South Quay, Wicklow town, Co Wicklow, was arraigned at Wicklow Circuit Criminal Court, where he entered a guilty plea to one count of assault causing harm.

The court heard that on May 9, 2023, at East Pier, South Quay, Wicklow town, the defendant assaulted Alan Flahive, causing him harm.

Mr Maguire had been due to stand trial before a jury.

Judge Patrick Quinn directed that the jury be brought out for the arraignment. However, following the guilty plea, Judge Quinn told the jury: “This outcome wouldn’t have happened if you weren’t here,” adding, “it doesn’t require a jury anymore, but I wish you luck.”

The court was told that Mr Maguire is currently in custody on remand in relation to this matter and is nearing the end of a sentence previously imposed in the District Court by Judge David Kennedy.

Counsel for the accused, Justin McQuade BL, outlined the facts of the case. The court heard that one punch was thrown by Mr Maguire during the assault.

Mr McQuade stated it was his client’s “honest belief” that he needed to use force.

Barrister for the prosecution, James Kelly, submitted that the force used was “disproportionate” and indicated that a victim impact report is required.

Judge Quinn remanded Mr Maguire in custody.

He is due to be produced before the court for sentencing on February 19.
