Wexford motorcyclist who was seriously injured in crash has careless driving case struck out
Wexford PeopleA charge of careless driving against a motorbike rider was struck out by the court.
Garda Cullen gave evidence to the court that on June 20 2024 he attended at the scene of a two vehicle collision which had taken place at the N80 Ryland Lower.
The collision occurred when a motorbike being driven by Conor McDowell (29) of Effernogue, Ferns, Enniscorthy, Wexford, pulled out into the path of an oncoming lorry. The lorry clipped the side of the bike causing serious injuries to McDowell.
McDowell could not recall what happened.
Donna Kelly BL, counsel for the accused, asked Judge John Cheatle to refrain from imposing a conviction in circumstances where McDowell’s insurance paid out €29,000 due to the accident, making it impossible for the accused to gain insurance.
Judge Cheatle struck the matter out noting the accused came off worse from the situation and has no previous convictions.
