Wexford man received a ten month prison sentence for assault
Wexford PeopleA Wexford man received a prison sentence in connection with an assault that occurred in a Enniscorthy pub.
Gorey District Court heard that on October 31 2022 the injured party approached Robbie O’Neill (27) of Sweetfarm, St Johns, Enniscorthy, Wexford, in D Bar Enniscorthy to greet him. O’Neill then headbutted the victim.
Garda Bergin gave evidence that while taking a statement from O’Neill there was a visible injuries to his face, with the victim also suffering from broken teeth.
During interview O’Neill said he had no recollection of the incident but offered to pay for any medical treatment required.
The injured party gave a victim impact statement outlining to the court how he previously enjoyed socialising in bars but since the incident is worried something similar will happen. He added that his confidence has been affected due to receiving a broken nose and multiple chipped teeth.
Solicitor for the defendant, Marie Murphy, said that records she had received indicated there had been one chipped tooth and no fracture.
Judge John Cheatle remarked that if the injuries are as bad as the injured party set out in his statement then it is at the high end of the jurisdiction to be dealt with within the district court and imposed a 10 month imprisonment sentence.
O’Neill opted to appeal the decision. The matter will be heard before the next sittings of District Court Appeals sitting at Wexford Circuit Court.
