Unnamed hospital worker loses Covid work-from-home challenge

By Donal Gilhooly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

An unnamed hospital worker lost her challenge over a Covid-19 work-from-home refusal at the High Court, reported on 7 December 2021.

The challenge concerned the hospital’s refusal to let her work remotely because of her health risks. The court held the dispute arose solely from her individual employment contract and was not amenable to judicial review.

The judge also concluded that the worker had not shown a breach of fair procedures or that the decision was irrational. The medical reports did not establish that she needed to cocoon or was at very high risk from Covid-19.
