Unnamed appellant's indecent assault trial can proceed

By Rory Hanlon

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

An unnamed appellant's appeal against refusal to prohibit his indecent assault trial was dismissed by the Irish Court of Appeal, reported on 29 July 2025.

He was charged in September 2021 with indecent assault contrary to common law and the Offences Against the Person Act 1861, and pleaded not guilty. The High Court, presided over by Judge Bolger, refused his application in March 2024 and dismissed it in April 2024.

The Court of Appeal found the trial could proceed under the trial court's oversight. It rejected arguments concerning delay, unavailable witnesses and mental-health difficulties, including suicidal ideation, as insufficient to justify prohibiting the trial.
