The trial of Bernard Daly, Tiarnan O'Mahoney and Aoife Maguire was continuing at Dublin Circuit Criminal Court before Judge Patrick McCartan. They were charged with trying, between March 2003 and December 2004, to conceal from Revenue accounts linked to former Anglo Irish Bank chairman Sean FitzPatrick. They had pleaded not guilty. The proceedings were reported on 21 July 2015.
The account names included Triumvirate Properties Ltd and Sean FitzPatrick Trust/Crohan O'Shea Trust. The report also listed Lock Ltd and Carnahalla Ltd, alongside Lock Ltd/Suzie Ltd and Carnahalla Ltd/Suzie Ltd.
Det Sgt Daniel McGinty described interviewing Mr Daly on 31 October 2013 at Ballymun Garda Station. Mr Daly had arranged to attend and was not under arrest. Prosecution counsel Dominic McGinn SC read out the interview.
Mr Daly told gardaí that his work on a 2003 Revenue audit included supplying a list of non-resident accounts. He could not confirm that it contained every required name. He denied pressure to leave accounts out, including any such request from Mr O'Mahoney or Mr FitzPatrick. He said he knew of no attempt or conspiracy to delete accounts and had no involvement in IT.
Giving evidence on 20 July 2015, former senior IT manager Seamus McGill said Ms Maguire wanted Susie Ltd and Lock Ltd to appear to have been established under other names. He said the changes would remain traceable through an audit trail and that the request's unusual nature worried him.
Mr McGill said IT associate director James Shaw had requested account deletions in 2004 and told him Ms Maguire would provide the account details. Questioned by her counsel, Patrick Gageby SC, he said he would not have accepted her authority to request deletions without hearing from Mr Shaw. He also accepted that he and Ms Maguire were following instructions conveyed by Mr Shaw.
