Fair City actor Tony Tormey’s claim against RTÉ returned to the Workplace Relations Commission on 16 December 2022 and was adjourned until the New Year.

Mr Tormey, who plays Paul Brennan, says he is entitled to a contract of indefinite duration under the Protection of Employees (Fixed-Term Work) Act 2003. RTÉ denies the claim, saying he was always happy to be a self-employed contractor.

Legal filings opened at the hearing claimed an RTÉ producer had said in 2003 that Mr Tormey was not permitted to work elsewhere on television. Adjudicating officer Breiffni O'Neill said he would need witness evidence about the claim.

Mr O'Neill asked to see Mr Tormey’s tax records dating back to 2004, and the actor’s legal team said they would be submitted. He said deciding the terms of any contract of indefinite duration would be difficult because Mr Tormey’s current pay rates included items such as holidays and sick pay.
