A Tipperary man was jailed for 12 years after receiving consecutive seven-year terms for offences against his sister and niece, with the final two years suspended. Mr Justice Patrick McCarthy sentenced the 53-year-old at the Central Criminal Court, finding the crimes against each victim similarly serious. The proceedings were reported on 6 July 2015.
He pleaded guilty to one rape charge and six sexual assault charges involving his sister. The offences took place at the family home in Tipperary between 1978 and 1982. He also pleaded guilty to five counts of defilement of a child, three sexual assault charges and one oral rape charge involving his niece. Those offences occurred at locations around the county between 2005 and 2007.
His sister's victim impact statement described psychological difficulties, flashbacks and problems trusting others. His niece said the abuse damaged her understanding of love and relationships. She described continuing anxiety and difficulty trusting people, and said she had come close to taking her own life.
The niece ended the relationship in 2008 and disclosed it to the family. After counselling, she reported the abuse to gardaí in 2012. The abuse of his sister was first reported then too.
Michael Delaney SC, defending, described a dysfunctional upbringing marked by sexual abuse of children. He said the man's father had allegedly sexually abused three of his sisters, while an uncle had allegedly sexually abused the man. Counsel said the man saw his mother stab his father when he was seven.
Counsel cited a psychological assessment indicating a low risk of further offending and sought a suspended portion to support rehabilitation. The judge said the man acknowledged his wrongdoing but understood little of his motivations. He described “borderline cognitive function”, which he said occurred in 90 per cent of offenders in such cases.
