Tiarnan O'Mahoney is on trial with Bernard Daly and Aoife Maguire at Dublin Circuit Criminal Court, charged with trying to hide accounts connected to former Anglo Irish Bank chairman Sean FitzPatrick from Revenue between March 2003 and December 2004.
All three have pleaded not guilty. The proceedings were reported on 16 June 2015.
Mr O'Mahoney and Mr Daly are accused of furnishing a tax-related list of bank accounts that omitted an account belonging to John Peter O’Toole, the former chairman’s brother-in-law. Mr O'Mahoney and Ms Maguire are accused of conspiring to destroy the records of six accounts and defraud Revenue.
On 15 June 2015, prosecution counsel Dominic McGinn SC alleged that attempts were made in 2004 to delete information about two of Mr O’Toole’s accounts and six other accounts to conceal them for the purpose of not paying tax. He alleged that all three accused were involved in attempting to delete Mr O’Toole’s accounts, and that Mr Daly and Mr O'Mahoney removed his name from the tax list.
Walter Tyrell, the former head of internal audit at Anglo and IBRC, said he had been unaware in April 2010 that fraud officer Patrick Peake, appointed to investigate the archiving of accounts, had participated in the team preparing accounts information for Revenue in 2003.
Mr Daly’s defence suggested that Mr Peake could choose which emails to examine and had not examined his own or those of Brian Gillespie. Mr Tyrell accepted there was a conflict of interest but said it was a matter for Mr Peake.
The trial was continuing before Judge Patrick McCartan.
