This report is a localnews.ie summary based on public court reporting and records; sources are listed below.
Thomas McEvaddy snr’s permission to challenge the Nama Act was set aside by the High Court, reported on 6 February 2015.
The challenge, brought by Mr McEvaddy and Thomas McEvaddy Developments Ltd, sought judicial review of Nama, IBRC, the State and receivers over alleged loan and property-related wrongs. Mr Justice Michael Peart ruled that some grounds were out of time and others insubstantial. He also held that claims against Nama based on alleged wrongs by Anglo Irish Bank could not proceed under the Nama Act, while an alleged interest-overcharging claim against IBRC could not be brought by judicial review. Claims against the State respondents were adjourned generally with liberty to re-enter.
