The Workplace Relations Commission awarded Thomas Delaney €10,000 after finding that NSP Expert Lab Solutions unfairly dismissed him. Adjudicator Conor Stokes said Delaney had been excluded from the investigation and disciplinary process and had no chance to answer the allegations or make representations.

The company relied on a recorded phone conversation between Delaney and a member of staff, which it said raised issues amounting to gross misconduct. Delaney said he believed the February 2024 conversation with the HR chief was confidential and that he had not consented to its recording. He lost his job in May 2024, after the recording was sent to the CEO, according to his account to the WRC.

The adjudicator cited Delaney’s loss of €1,085 gross pay per week during 14 weeks of unemployment and the lack of evidence that he had sought alternative work. He set compensation at €10,000 for loss of earnings.
