This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Szymon Stolarczyk lost his unfair dismissal claim at the Workplace Relations Commission, with adjudicator Eileen Campbell finding the dismissal fair and proportionate. The proceedings were reported on 3 October 2024.

The claim followed an incident on 15 December 2023 in which Mr Stolarczyk admitted stopping a 15-year-old girl during a delivery round and offering her chocolate from a company van. He argued that he had not been told during training not to share food with people on the street and that a lesser sanction, including a transfer, would have been appropriate.

The WRC heard that he was suspended with pay on 18 December 2023, dismissed for gross misconduct after an investigation and disciplinary process, and unsuccessful on appeal. Ms Campbell dismissed the complaint, finding that he was not unfairly dismissed.
