Supreme Court varies order for James Flynn retrial

By Aoife Loughran

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Supreme Court dismissed James Flynn’s appeal but varied the retrial order, directing that any retrial be for the conspiracy offence on the amended indictment. The court’s decision was reported on 26 March 2026.

The court said the Court of Appeal could order a retrial only for the offence on which Flynn had been convicted. It found that quashing the conviction did not undo the Special Criminal Court’s amendment to the indictment. The Supreme Court’s order permits a retrial on the amended particulars concerning an alleged conspiracy with Aaron Brady and another man to enter a home in Clogherhead on 22 and 23 January 2013 to steal the householder’s car keys.
