Supreme Court judgment delivered in renewable energy compensation cases

By Saoirse Doyle

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Supreme Court delivered a judgment on 21 January 2025 in cases involving Energia Group Holdings (ROI) DAC and GR Windfarms 1 Ltd and the Commission for Regulation of Utilities.

The cases concerned High Court challenges by two groups of renewable energy companies over a commission decision not to implement an EU compensation regulation where generators are told to switch off wind farms because of grid limitations. The decision was made through the commission’s Single Energy Market Committee.

The companies sought orders quashing the decision and declarations concerning compensation. Mr Justice Anthony Barr granted permission to bring the challenges on an ex parte basis. Eirgrid Plc was a notice party.

This report covers an earlier stage of the case. Later developments are not reported here.
