The complaint concerned his dismissal by STL Logistics after an unscheduled Guinness keg delivery to a pub in Dublin’s north-east inner city. The dispute was whether dismissal for alleged gross misconduct was fair.

Adjudicating officer Andrew Heavey preferred Gradinaru’s evidence that the delivery formed part of a pub-to-pub swap. He found the conduct was not gross misconduct and dismissal was disproportionate, particularly as no loss to the company was identified.

He awarded the 11 workers whose complaints he upheld between €2,320 and €21,000 each.
