The Circuit Criminal Court heard evidence on 6 July 2015, day 14 of the trial of three Anglo officials accused of hiding accounts connected to former Anglo chairman Sean FitzPatrick. The proceedings were reported on 7 July 2015.
Bernard Daly, Tiarnan O’Mahoney and Aoife Maguire have pleaded not guilty. The seven alleged offences concern events in 2003 and 2004.
All three are accused of trying to delete references to two accounts in John Peter O’Toole’s name from Anglo’s Core Banking System. Bernard Daly and Tiarnan O’Mahoney also deny omitting his name from a list supplied to Revenue of people with non-resident accounts worth more than €100,000 in 1995. Tiarnan O’Mahoney and Aoife Maguire further deny attempting to delete six other accounts connected to Sean FitzPatrick.
Brian Gillespie, the bank’s former head of compliance, said he was tasked in 2003 with supplying Revenue with documentation on non-resident accounts on which Deposit Interest Retention Tax might have been owed.
Brian Gillespie said Sean FitzPatrick asked about John Peter O’Toole’s non-resident account. The court had previously heard that John Peter O’Toole was Sean FitzPatrick’s brother-in-law. Brian Gillespie confirmed that the account had an Australian address, held more than IR£14,000 in June 1995 and was later closed. He said Sean FitzPatrick made clear that a family member’s account was not to be returned to Revenue.
Brian Gillespie also said Tiarnan O’Mahoney required his approval before accounts were submitted to Revenue. He said Bernard Daly asked whether he would delete an account if Sean FitzPatrick asked him to.
