Sean Feehan wins injunction after Merchant Shipping Act offences

By Ruairí Dolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Sean Feehan secured a temporary injunction in the High Court, reported on 13 April 2016, after pleading guilty to three Merchant Shipping Act offences at Caherciveen District Court in September 2015. The Office of Public Works had revoked his two permits to land visitors at Skellig Michael, off the Co Kerry coast, citing safety concerns.

The injunction prevented the OPW from issuing two of four permits to other parties while Mr Feehan challenged the revocation as invalid, unlawful and unconstitutional. He said his safety record, aside from the convictions, was exemplary and claimed other boatmen convicted over safety issues had not lost their licences.

This report covers an earlier stage of the case. Later developments are not reported here.
