Sandra Clarke’s statutory redundancy claim against Camrue Catering Limited, trading as Becketts Hotel, was upheld by the Workplace Relations Commission after a hearing on 9 August 2022.
The employer conceded that Clarke was entitled to €17,280.23 in statutory redundancy and said it intended to contact her about a payment schedule. Adjudication officer John Harraghy said there was no dispute over the validity of the claim or the amount owed.
Clarke had worked as a restaurant supervisor and was laid off during the Covid-19 pandemic. The award was subject to her having been in insurable employment during the relevant period. The decision also stated that any period in which she received the Pandemic Unemployment Payment was a non-reckonable break in service.
Harraghy found that her separate minimum-notice complaint was not well founded. He said she was deemed to have left her employment voluntarily because she had claimed redundancy, and had therefore lost her right to notice. The decision was dated 17 August 2022.
