Rosemary and Stephen Mongan launched a High Court action over housing priority, reported on 7 April 2016. The family were living in emergency hotel accommodation in Dublin city centre with their young child after becoming homeless in County Longford. They challenged South Dublin County Council’s refusal to grant priority status for housing allocation.
The Mongans sought orders quashing the council’s decision and requiring it to reconsider their application. They also sought declarations that the refusal lacked adequate reasons, was irrational, involved an error of law and breached constitutional and European Convention rights.
Mr Justice Richard Humphreys granted permission to bring the action, which was returnable later that week.
