In a judgment delivered on 7 October 2019, Mr Justice Garrett Simons set aside the Circuit Court decision in favour of Tanager DAC. He said the fund could not enforce the possession order or sell the property, and Ryan’s protective certificate continued in force while his personal insolvency application was considered.

The judge found that failing to disclose the possession order was unsatisfactory but did not amount to material non-disclosure. He adjourned the matter to the following week to allow the parties to consider his decision.
