RB had his deportation order reaffirmed by the Court of Appeal, reported on 23 February 2017, after the Minister’s appeal succeeded.

The court found the High Court had erred in reviewing the Minister’s consideration of RB’s claimed risk of assault linked to his association with Jehovah’s Witnesses. It also held that medical reports about suicidal ideation did not require the deportation order to be revoked.

The Court of Appeal vacated the High Court order and dismissed RB’s judicial review application.
