Paul Dunne was awarded €25,000 after the Workplace Relations Commission found he was unfairly dismissed by Randox Teoranta, following a hearing on 19 November 2021.
The WRC decision says Dunne tested a 0.7mg CA15-3 conjugate after his manager had instructed him to use a 0.5mg version. He said he understood the restriction to apply at the verification stage, and had recorded that the test was not to be used for verification.
The adjudication officer found the investigation had failed to account for the distinction between pre-verification testing and verification, and that the investigator had reached a view on culpability without meeting Dunne. The decision found that dismissal was unreasonable, while also finding that Dunne’s conduct contributed significantly to it.
The WRC reduced compensation by 50% for that contribution and ordered Randox Teoranta to pay €25,000. The decision is dated 15 March 2022.
