Patrick McNamee loses appeal over unlawful-at-large charge

By Fionn Kelly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Patrick McNamee lost his appeal against an unlawful-at-large charge in the Court of Appeal, in a judgment delivered on 25 July 2017. The charge arose from an alleged breach of a temporary-release condition after alleged trespassing on residential property on 23 December 2015. The court held that the charge was linked to an alleged attempt to commit trespass, rather than simply failing to be of good behaviour, and dismissed his challenge. It also found that he had not shown an arguable legal basis for judicial review. The judgment did not determine the criminal charge itself.
