The Office of the Director of Corporate Enforcement’s application concerning seized FAI documents relating to John Delaney was adjourned in the High Court on 17 February 2020. The ODCE wants the court to determine whether the documents contain legally privileged material.
The documents were seized from the FAI offices at Abbottstown on 14 February during the ODCE’s inquiry into the association.
Ms Justice Leonie Reynolds said the documents might raise private issues concerning Mr Delaney and suggested he should be made a notice party. She adjourned the matter to later that week.
In earlier proceedings, the judge ruled that 14 passages in 16 documents provided by the FAI and Deloitte Ireland LLP contained legally privileged material that could not be used in the investigation. She ordered the privileged passages to be redacted so they would remain unseen by the ODCE.
