The Disclosures Tribunal examined whether Nóirín O'Sullivan inappropriately relied on unjustified grounds to discredit Sergeant Maurice McCabe at the O'Higgins Commission, reported on 8 February 2018. Tribunal chairman Mr Justice Peter Charleton said the inquiry had concluded hearing most evidence on the issue.

The chairman outlined questions for lawyers, including whether there was evidence of a deliberate or reckless mistake and whether a strategy to target Sergeant McCabe came from the organisation's senior leadership. He said he saw no evidence of an aggressive legal strategy and did not believe the commission had handled matters inappropriately.

Cyril Dunne denied making a remark about targeting Sergeant McCabe and said he was not involved in the commission's legal strategy. The tribunal was due to question Sergeant McCabe about the effect of the hearings when he gave evidence in the next module.
