Noel Mc Grath loses disability discrimination claim at WRC

By Niamh Kearney

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Noel Mc Grath’s disability discrimination complaint against Aurivo Co-Operative Society Limited was dismissed by the Workplace Relations Commission in a decision dated 8 June 2022; the hearing took place on 27 May 2022.

The complaint concerned service at the company’s store in Belmullet, Co Mayo, in March 2021, when Mc Grath attended without a face mask.

The adjudication officer found that the refusal to serve him was not related to disability and that discrimination had not occurred.

The decision records that Mc Grath said panic and claustrophobia made wearing a mask difficult. It also found he had not referred to a disability or medical reason during the exchanges with staff before service was arranged.

The WRC dismissed the complaint under the Equal Status Act as not well founded.
