The Workplace Relations Commission awarded nail technician Odonchimeg Genenbat €1,000 for unfair dismissal after she was let go from Love Your Nails about a month after starting work. She had asked for payslips and was dismissed without the usual procedures, according to the report.
Adjudicator Michael McEntee found that Genenbat could bring her complaint despite her short service, under a provision for workers who seek information about their pay. He said the lack of normal procedures made the dismissal unfair. Her employer, sole trader Colm Tyrell, did not attend the hearing; the adjudicator cited that failure as a factor in the award.
In an email noted by the adjudicator, Tyrell said the failure to provide payslips was an “administrative error”. He said he had decided not to continue Genenbat’s employment because of alleged performance issues, citing an inability to complete customer treatments in the time allocated and customer satisfaction issues.
