This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Ms Y’s High Court challenge aimed at stopping the HSE inquiry into her care was struck out on 3 November 2015 following an agreement between the parties. The matter came before the President of the High Court, Mr Justice Nicholas Kearns.

Richard Kean SC, for Ms Y, told the court the matter could be struck out, with no further order required. Maurice Collins SC, for the HSE, said his client consented. No further details were given to the court.

In a statement on 2 November 2015, Ms Y’s representatives said the HSE had confirmed it would not publish the draft report into her care, circulate it within the HSE or disclose it to any third party. They said the HSE had also confirmed the report would never be used in a manner that infringed Ms Y’s legal rights.

The statement said the proceedings had effectively achieved their aim of quashing the report and rendered it entirely redundant. An HSE spokesman said the report had not been quashed. Ms Y’s lawyers said a damages claim would be advanced.
