A woman sought the protection of the court after an alleged violent incident involving her daughter

The mother appeared at an in-camera family law special sitting of Bray District Court seeking an interim protection order against her daughter.

The mother testified under oath that her daughter assaulted her and caused substantial damage to her car.

It was alleged that her daughter attacked her with a bottle of deodorant. Gardaí arrived at the scene and placed the daughter under arrest, but released her from custody minutes later.

The woman told the court that gardaí advised her to attend Bray Courthouse to seek a barring order.

Judge David Kennedy noted that the woman could be granted either a barring order or a protection order.

A protection order is a short term measure which prevents a person from using or threatening violence but does not require them to leave the family home.

A barring order is a more serious application and requires the respondent to leave the home and stay away from the applicant. It provides a higher level of protection once the court is satisfied it is necessary.

Judge Kennedy granted an interim barring order and directed gardaí to serve the order on the daughter.

Barring orders must be formally served on the individual before they come into effect.

The matter was scheduled for a full hearing on Monday, January 26.
