Michael McNamara wins €52,000 pay claim against DHL

By Niamh Kearney

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Michael McNamara won a €52,000 pay claim against DHL Express (Ireland) Ltd under the Payment of Wages Act 1991 before the Workplace Relations Commission, in a decision published on 29 March 2023. The proceedings were reported on 29 March 2023.

Adjudicating officer Aideen Collard found that McNamara had an established contractual entitlement to time-away-from-base allowances through custom and practice. DHL disputed the claim, arguing the payments were expenses rather than wages and challenging the draft document relied on by McNamara.

The WRC ordered DHL to pay €52,000 for losses caused by withdrawing the allowance, subject to any lawful deductions.
