MIBI appeal over Setanta claims continues in Court of Appeal

The Motor Insurers Bureau of Ireland’s appeal over liability for Setanta insurance claims was continuing before the Court of Appeal, with the hearing expected to conclude on 14 January 2016, according to a report published that day.
The MIBI is challenging a High Court judgment requiring it to pay claims involving people insured by Setanta when the company was liquidated. The Law Society argues that agreements governing the MIBI require payment when a member becomes insolvent.
The High Court had been asked to determine whether the MIBI or the Insurance Compensation Fund was liable for the claims. Approximately 1,750 claims involving Setanta policyholders remained after the company’s liquidation.
This report covers an earlier stage of the case. Later developments are not reported here.
