Meta Platforms Ireland Ltd challenged a proposed ban on processing personal data for behavioural advertising in the High Court, reported on 20 November 2023.
The Data Protection Commission’s enforcement notice required the company to stop using data drawn from users’ online activities and interests for advertising within seven days. Meta sought to have the notice quashed, arguing that its requirements were unclear and that the process breached fair procedures; these were Meta’s claims, not findings by the court.
On 20 November 2023, Mr Justice Cian Ferriter granted Meta permission to bring a judicial review and a short interim stay on the notice taking effect. He said the short compliance period and potential criminal consequences favoured the stay. The matter was due back before the court later that week.
